(Official English Translation for Public Notice in Indonesia)

On behalf of our client, PT. MADURA UTAMA MANDIRI, an Indonesian limited liability company duly established under the laws of the Republic of Indonesia, having its registered address at Jl. Mangga Dua Raya No. 39, West Jakarta 11110, we hereby make the following announcement:

JACK AND JILL KIDS PTY LTD, a company established under the laws of Australia, having its registered address at Level 1, 17 Grey Street, St Kilda, Australia 3182, is the sole and rightful owner of the registered trademark:

JACK N’ JILL

This trademark was officially filed with the Directorate General of Intellectual Property, Ministry of Law and Human Rights, Republic of Indonesia under registration number D002017010730, dated March 8, 2017, and has been approved and registered to protect goods within the designated scope.

Based on a Letter of Authorization dated May 1, 2018, our client PT. MADURA UTAMA MANDIRI has been officially appointed as the Exclusive Importer and Distributor of JACK AND JILL KIDS PTY LTD products in Indonesia.

It has recently come to our attention that there are counterfeit/fake products circulating in the Indonesian market using the “JACK N’ JILL” brand illegally and without authorization, and/or being purchased or sourced from parties other than our authorized client.

We hereby issue a serious legal warning: any individual or entity currently involved in the production, importation, distribution, sale, or storage of such counterfeit products is subject to strict legal action, which includes but is not limited to:

• Civil lawsuits for damages under Article 83 Paragraph (1) of Indonesian Law No. 20 Year 2016 concerning Trademarks and Geographical Indications.

• Criminal prosecution, with penalties of up to 5 (five) years imprisonment and/or a fine of up to IDR 2,000,000,000 (Two Billion Rupiah), in accordance with Article 100 Paragraph (1) of the same law.

• Additionally, anyone trading counterfeit or unauthorized goods may face 1 (one) year of imprisonment.

We strongly demand that within 7 (seven) days from the date of this notice, all parties involved must immediately cease the manufacturing, importing, distributing, selling, or storing of fake/counterfeit JACK N’ JILL products, and withdraw such products from the market and destroy them. This is to avoid any potential legal action (both civil and criminal) from our client.
